Heard the learned counsel appearing on behalf of the petitioners through Video Conferencing and the learned counsel appearing on behalf of the respondent State.

The petitioners are apprehending their arrest in connection with Rikhiya PS Case No.132 of 2025, for offence registered under section 126(2), 115(2), 117(2), 118(1), 109(1), 76 and 3(5) of BNS, 2023, pending in court of learned Judicial Magistrate, First Class, Deoghar.

Learned counsel for petitioners submits that the FIR has been lodged against 24 persons and so far as the allegation of outraging the modesty is concerned that allegation is against one Ashok Yadav and the said Ashok Yadav is not the petitioner herein and so far as these petitioners are concerned there are general and omnibus allegations against all the accused persons and he submits in view of that anticipatory bail may kindly be granted.

Learned State counsel opposes prayer and submits that allegations are there of assault.

On perusal of the FIR, it transpires that so far as outraging modesty is concerned, that allegation is made against one Ashok Yadav and said Ashok Yadav is not the petitioner herein, and so far as these petitioners are concerned, there are general and omnibus allegations against them, and in the attending facts and circumstances of the present case, I am inclined to grant anticipatory bail to the petitioners.

Accordingly, petitioners, above named, are hereby directed to surrender before learned court within three weeks from today, and in event of their surrender/arrest, petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/-(Rupees Twenty Five Thousand) each, with two sureties of like amount each, to satisfaction of learned Judicial Magistrate, First Class, Deoghar, in connection with Rikhiya PS Case No.132 of 2025, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
