2/11.08.2026 Heard learned counsels for petitioners and for State.

The petitioners are apprehending their arrest in connection with Bagodar PS Case No.34 of 2026, for offence registered under section 126(2), 109, 118(1), 117, 115, 79, 74, 303(2), 3(5) of BNS, 2023, pending in court of learned Judicial Magistrate First Class, Giridih.

Learned counsel for petitioners submits that the petitioners have been falsely implicated in this case and the petitioners side and the informant side are aganets and altercation took place due to land dispute and there are case and counter case between the parties and false allegations are made of outraging the modesty. He next submits that the petitioners are having no criminal antecedent as disclosed in paragraph no.13 of the petition.

Learned State counsel opposes prayer and submits that the allegations are there of assault.

Considering that both the sides are the aganets and altercation took place due to land dispute and further there are case and counter case between the parties and the petitioners are having no criminal antecedent as aforesaid, I am inclined to grant anticipatory bail to petitioners.

Accordingly, the petitioners, above named, are hereby directed to surrender before learned court within three weeks from today, and in event of their surrender/arrest, the petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each, with two sureties of like amount each, to satisfaction of learned Judicial Magistrate First Class, Giridih, in connection with Bagodar PS Case No.34 of 2026, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
