Judgment
This original application is registered on the basis of the letter petition dated 13.10.2023 sent by one Vinod Kumar Singh resident of Kakarahiya Post Lohta, District Varanasi, UP.
In the letter petition, complaint of the applicant is that in Village Kakarahiya illegal plotting is going on which is changing the nature of the agricultural land which is affecting the traditional cultivation pattern.
It has been alleged that the sewage is discharged in the open agricultural field and due to connection of the drains with irrigation canal fertility of land in the area is affected and hazardous elements are entering the agricultural fields.
It is further alleged that in the race of urbanization ponds, parks etc are not protected and construction is being raised on green and wetland area.
Though, we find that the complaint lacks in necessary particular in respect of any specific area of the village or town where such violations are taking place but having regard to the nature of the allegations made in the letter petition, we deem it proper to direct Secretary, Uttar Pradesh Pollution Control Board to duly consider the grievance raised in the letter petition and ascertain the truthfulness of the allegation and also find out the correct position and thereafter take remedial action, if required. Let the said exercise be completed within a period of three months from the date of receipts of copy of this order.
A copy of the complaint along with copy of this order be forwarded to the Secretary, UPPCB by email or compliance.
The Secretary, UPPCB will submit the action taken report before the Registrar General of the Tribunal within four months. If found necessary, the matter may be placed before the Court for consideration.
The Original Application is disposed of accordingly.
