Judgment
When this Court raised a query regarding the maintainability of the present writ petition seeking quashing of the C.C. by invoking the jurisdiction of this Court under Article 226 of the Constitution of India, in view of the principle laid down by the Hon'ble Apex Court in Pradnya Pranjal Kulkarni v. State of Maharashtra1, learned counsel for the petitioner seeks permission of this Court to withdraw the writ petition with liberty to file a quash petition seeking quashing of the final report.
Permission is accorded.
In view of the same, the Writ Petition is dismissed as withdrawn, with a liberty as sought for. No order as to costs.
The Registry is directed to return the certified copy of the final report to the learned counsel for the petitioner, after obtaining proper authorization.
Pending miscellaneous petitions, if any, shall stand closed.
