This application has been filed by the applicant seeking transfer of TSA No.24/2022 titled as `M/s United Cold Chain & Food Processing Ltd. vs. 'Clnara Bank (Syndicate Bank) pending before learned DRT-III, Delhi to DRT-I, Lelhi for hearing.

Learned counsel for the applicant submits that the S.A. (TSA) No.i4/12022 filed  by the applicant is  pending  before the  learned  DRT-III,  Delhi.     Learned counsel further submits that in the pending S.A. the applicants have also filed certain applications,  but the learned Presiding Officer, DRT-III, Delhi is not taking up the matter.   Learned counsel also submits that the auction of the property in question has already been taken place and the bank may at any time confirm the sale.    In these circumstances, the learned counsel prays that   the prayer in the application would stand satisfied in case the learned Presiding Officer, DRT-III, Delhi is directed to take up  the S.A. and the pending application of the applicant and decide the same at the earliest.    He states that the next date before the learned DRT is 03.03.2023.

Ms. Anchal, Officer of respondent   bank, is present.    She states that the sale has been confirmed and the possession of the property   has been handed over to the auction purchaser.

Heard.   The learned Presiding Officer, DRT-III, Delhi is requested to take up the applicant's S.A. and pending application on 03.03.2023, and if it is not possible  to  take  up  the  matter  on  the  said  date,  then  let  it  be  taken  up immediately thereafter, and pass appropriate orders in accordance with law as expeditiously as possible.

With the above direction, the application stands disposed of. File be consigned to record room.

Copy of the order be sent to the learned DRT.
