This application has been filed by the applicants seeking transfer of their S.A. No.136/2023 titled as "Sarfaraz Khan & Ors. vs. Union Bank of India"  from learned DRT-II, Delhi to learned DRT-I, Delhi with direction to hear the same at the earliest.

The learned counsel for the applicants states that the property in question is going to be sold in e-auction on 28.03.2023.    Learned counsel submits that aggrieved by the actions being taken by the respondent El, the applicants have filed an S.A. before the learned DRT-II, Delhi in respect of the property question. Learned counsel for the applicants further submits that since the learned DRT-II, Delhi has no regular Presiding Officer and its additional charge has been given to the  learned  Presiding  Officer,  DRT-III,  Delhi,  his  matter  is  not  taken  up  for hearing.   Learned counsel for the applicants states that the next date fixed in the matter  before  the  learned   DRT  is 22.05.2022.   In  these  circumstances,  the learned  counsel  prays that either the  S.A.  may be transferred  to the  learned DRT-1, Delhi for hearing or the learned Presiding Officer, DRT-III, Delhi, who is  holding  additional  charge  of  DRT-II,  Delhi,  may  be  directed  to  take  up  the applicants' S.A. and the application for interim relief  and decide the same at the earliest.

Heard.  The  learned  Presiding  Officer,  DRT-III,  Delhi,  who  is  holding additional charge of learned DRT-II, Delhi, is requested to take up the applicant's S.A.  No.136/2023 and application for interim relief at 12 noon today and pass appropriate orders in accordance with law.

With the above direction, the application stands disposed of, File be consigned to record room.

Copy of the order be sent to the learned DRT.
