This  matter has  been  taken  up  by  me  through Video  Conferencing  on being  mentioned  by the learned counsel for the applicant on the ground that property in question is going to be  auctioned on 10.03.2023.

Misc. Application No.91/2023

This application has been filed by the applicant seeking direction to the learned DRT-II, Delhi to take up the S.A. 860/2022, titled as 'Dr. Veena Tiwari Vs. Corporation Bank', filed by the applicant and decide the same at the earliest.

The  learned   counsel  for  the  applicant  states  that  the  auction  of  the property in question has been scheduled for 10.03.2023.   He further states that the applicant has filed an S.A. (No.860/2022) and application (I.A. No.352/2023) for stay  of auction  notice,  which  are  pending  before     learned  DRT-II,  Delhi. Learned counsel for the applicant  submits that the learned DRT-II, Delhi has no regular Presiding Officer and its additional charge has been given to the learned Presiding Officer, DRT-III, Delhi and his matter is not being taken up for hearing. In these circumstances, the learned counsel prays    that the learned Presiding Officer, DRT-III, Delhi, who is holding additional charge of DRT-II, Delhi, may be directed to take up   the applicant's S.A. and application for stay at the earliest and decide the same before 10.03.2023.

Heard.  The  learned  Presiding  Officer,   DRT-III,   Delhi,  who  is  holding additional charge of learned DRT-II, Delhi, is requested to take up the applicant's S.A. No.860/2023 and application for stay (I.A. No.352/2023) on 06.03.2023, and if it is not possible to take up the matter on the said date, then let it be taken up immediately thereafter, and pass appropriate orders in accordance with law.

With the above direction, the application stands disposed of. File be consigned to record room.

Copy of the order be sent to the learned DRT.
