Misc. Application No.48/2023
This application has been filed by the applicant seeking direction to the learned DRT-II, Delhi to hear and adjudicate the I.A Nos.3902/2022, 3920/2022 and I.A. No.171/2023 at the earliest.
Learned counsel for the applicants submits that the S.A. (TSA) No.61/2022 filed by the applicant is pending before the learned DRT-II, Delhi. Learned counsel further submits that in the pending S.A. the applicants have filed three applications, i.e. I.A. No.3902/2022 seeking direction to the respondent bank to release the household goods, I.A. No.3920/2022 seeking direction to respondent bank to grant access to the terrace for the purpose of maintenance and service of telecom tower and I.A. No.171/2023 assailing the sale notice dated 16.01.2023, but the learned Presiding Officer, DRT-III, Delhi is not taking up the matter. Learned counsel also submits that earlier on two occasions the property in question was put to auction and there is an apprehension that the property will be put to auction for the third time in the near future. Learned counsel further submits that the learned DRT-II, Delhi has no regular Presiding Officer and its additional charge has been given to the learned Presiding Officer, DRT-III, Delhi. In these circumstances, the learned counsel prays that the learned Presiding Officer, DRT-Ill, Delhi, who is holding additional charge of DRT-II, Delhi, may be directed to take up •the I.As. in question at the earliest and decide the same. He states that the next date before the learned DRT is 03.03.2023.
Heard. The learned Presiding Officer, DRT-III, Delhi, who is holding additional charge of learned DRT-II, Delhi, is requested to take up the applicants' I.A Nos. 3902/2022, 3920/2022 and 171/2023 on 03.03.2023, and if it is not possible to take up the matter on the said date, then let it be taken up immediately thereafter, and pass appropriate orders in accordance with law.
With the above direction, the application stands disposed of. File be consigned to record room.
Copy of the order be sent to the learned DRT.
