Judgment
The petitioner is aggrieved by the action of the respondent No.4 in not mutating the petitioner's name in the revenue records based on the petitioner's application dated 01.04.2014 despite of specific direction from the respondent No.3 vide proceeding dated 10.12.2014 in respect of agricultural land admeasuring ac.1-00 guntas in Sy.No.221, situated at Shivanenigudem village, Chityal Mandal, Nalgonda District (hereinafter referred as 'subject property') and seeking a consequential direction to respondent authorities more particularly respondent No.4 to mutate the name of the petitioner in the revenue records based on petitioner's application dated 01.04.2014 in respect of subject property.
The brief facts of the case are that the petitioner's husband is the absolute owner and possessor of the subject property having purchased the same from Sri Jakkula Narsimhulu, vide Registered Sale Deed bearing document No.3804/2010 dated 24.04.2010 registered at Joint Sub-Registrar, Nalgonda. It is further submitted that due to ill-health the petitioner's husband expired on 23.05.2012 leaving behind the petitioner herein as his legal heir. In this regard, the petitioner along with her son have made representation dated 01.04.2014 to the respondent authorities requesting to mutate the subject property in favour of the legal heirs of Late Sri Ankala Govinda Rao and for issuance of pattedar pass book in the name of legal heirs. It is further submitted that though a requisition was made in the year 2014 in respect of the subject property but, no action has been taken thereon. Hence, the petitioner filed the present writ petition.
Learned Assistant Government Pleader appearing for respondent authorities submits that if the petitioner's representation dated 01.04.2014 is pending consideration, the same will be considered and appropriate orders would be passed strictly in accordance with law and prayed to pass appropriate orders.
Considering the submissions made by the learned counsel on either side, and without expressing any opinion on the merits of the case, this writ petition is disposed of with consent directing the respondent authorities concerned to consider the petitioner's representation dated 01.04.2014, after putting all the effected/interested parties on notice and upon enquiry, pass appropriate orders, strictly in accordance with law, as expeditiously as possible, preferably within a period of six (06) weeks from the date of receipt of a copy of this order and communicate the order to the petitioner. If the said representation was already considered, the orders passed thereon shall be communicated to the petitioner.
Accordingly, this Writ Petition is disposed of. There shall be no order as to costs.
Miscellaneous applications, if any pending, shall stand closed.
