Judgment
Honourable Mr. Justice K.M. Thaker
Heard Mr. Choksi, learned advocate for the applicant. The applicant has prayed for below mentioned relief/s:

(B)This Hon''ble Court may be pleased to restore the above preferred SCA 15980-2011.
(C) This Hon''ble Court may be pleased to dispense with an affidavit in support of this application.
(D) This Hon''ble Court may be pleased to pass such proper other further orders as may deem just and proper looking to the facts and circumstances in the interest of justice.
Having regard to the details mentioned in the application and the submissions made by the learned advocate for the petitioner satisfactory explanation has been given about the absence of the learned advocate at the time of hearing. Sufficient cause is made out in support of the request. Therefore, order dated 6.8.2012 is recalled and the office is directed to restore the proceedings of SCA No.15980 of 2011 to its original file and list the petition being SCA No.15980 of 2011 for further hearing in due course before appropriate bench taking up the subject matter. With the aforesaid clarification the application stands disposed of accordingly.
