Judgment
Honourable Mr. Justice K.M. Thaker
Heard Mr. Dave, learned advocate for the applicant.
Rule.
Mr. Shah, learned AGP, waives service of notice of rule for the opponent - State. In present application, the applicant has prayed for below mentioned relief:-
7(a) This Hon''ble Court may be pleased to allow this application by restoring S.C.A. No. 6878 of 2012 to its original file, which is dismissed for non-prosecution.

(c) As the matter is dismissed for default because of remaining absence of the advocate for the petitioner, and affidavit to accompany this application may kindly be disposed with.
Having regard to the details mentioned in the application and explanation offered by learned advocate for the applicant, sufficient cause to recall the order dated 24.7.2012 is made out. Having regard to the nature of relief prayed for in para-7(c), office is directed to dispense with the affidavit. The order dated 24.7.2012 passed in Special Civil Application No.6878 of 2012 is recalled and the office is directed to restore the writ petition being Special Civil Application No. 6878 of 2012 to its original file. The main writ petition being Special Civil Application No.6878 of 2012 be listed for further hearing on 16.8.2012.
Present application stands disposed of accordingly. Rule is made absolute in above terms.
