Judgment
Honourable Mr. Justice K.M. Thaker
Heard Mr. Acharya, learned advocate for the applicant. The applicant has preferred present application seeking below mentioned relief:-
3(B) Your Lordships may be pleased to restore the main matter SCA No. 10839/12 for appropriate further orders in the interest of justice.
Having regard to the averments made in the application and considering the submissions made by learned advocate for the applicant - writ petitioner, the order dated 24.9.2012 passed in Special Civil Application No. 10839 of 2012 is recalled and the writ petition being Special Civil Application No. 10839 of 2012 is restored to its original file.
The office shall list the writ petition (Special Civil Application No. 10839 of 2012) for hearing in due course.
2.1 Since facts are said to have been taken from the record, affidavit in support of present application is dispensed with.
With the aforesaid observations and direction, present application is allowed and stands disposed of accordingly.
