This application is filed by the Liquidator under Section 60(5) of the IBC, 2016 r.w. Rules 11 & 13 of the NCLT Rules, 2016.
It is noted that already an order was passed on 25.08.2023. In that order, it was mentioned that the moratorium period was as per Section 14 of the IBC. While mentioning that there was an inadvertent error. The moratorium period was under Section 33(5) of the IBC. To that extent, the order is corrected.
The learned counsel for the respondent/Regional Provident Fund Commissioner appears and seeks two weeks’ time to file a reply.
Two weeks’ time is allowed with the affidavit filed within two weeks.
With this, list the matter on 12.01.2024.
