Judgment
This original application is registered on the basis of the letter petition received from one Rajendra Sharma, resident of Shiv Colony, Kota Road, Rawatbhata, Chittorgarh with the allegation that Nagar Palika Rawatbhata is dumping the waste outside the dumping yard near Shiv Colony and Kota Road and causing damage to the environment and creating serious health hazard to the local residents at Rawatbhata. It is also alleged that said dumping ground has created huge air and water pollution in the Mukundra Forest area and River Chambal.
The letter petition raises substantial issue relating to compliance of the environmental norms.
Having regard to the nature of grievance raised in the letter petition, we are of the opinion that the grievance needs to be first looked into by the Member Secretary, Rajasthan State Pollution Control Board (RSPCB).
Hence, we dispose of the present OA directing the Member Secretary, RSPCB to duly look into the grievance of the Applicant and take appropriate remedial action in accordance with law and submit action taken report within three months before the Registrar of Central Zonal Bench of the Tribunal. If found necessary, the matter will be listed before the Central Zonal Bench, Bhopal after receipt of report.
