Judgment
In Original Application No. 895/2022 the grievance was against the industrial unit namely Shyampuria Milling Industries, Compound Khasra No. 7/2, village Rampura Dehat Kashipur Road, Rudrapur, District Udhamsingh Nagar and the allegation was that the two companies namely M/s Bright Metal Refinery and OMGL Refinery involved in the activity of gold refining were discharging effluent causing damage to environment and creating serious health hazard. The Tribunal vide order dated 20.02.2023 had constituted a Joint Committee with a direction to the Committee to look into the complaint and take appropriate remedial action if violations are found. It was further observed that the Committee will submit action taken report before the Registrar General who shall place the report before the Bench if found necessary for any further order. Accordingly the original application was disposed of.
On the basis of report dated 19.05.2023, submitted by Joint Committee, present M.A. No. 80/2023 has been registered. The report reflects that so far as M/s OMGL Refinery is concerned it has shifted somewhere else and another Refinery M/s Bright Metal Refinery is not found to be operating and is in the process of shifting to some other place in Haryana.
Hence at this stage, no ground is made out to take any further action in the matter however, if the unit M/s Bright Metal Refinery is not shifted then the concerned authority will ensure full compliance of all the environmental norms by the said unit.
The M.A. disposed of accordingly.
