Waseem Ahmad vs State of U.P.

Grievance in this application is against violation of environmental norms by M/s Anand Export, Mehlakpur Road, Paper Mill Chowraha, Agwanpur, Moradabad, U.P. in operating aluminum melting furnaces, metal treatment and die casting furnace with copper, aluminum and brass electro chemical plating plant with polish and other hazardous chemical treatment plant in the heart of the village which is running since morning till evening. Apart from other violations, there is illegal extraction of groundwater, discharge of untreated effluent in the drain meeting River Ramganga which is tributary of River Ganga.

Considering the above, vide order dated 10.1.2023, the Tribunal constituted a joint Committee comprising State PCB and District Magistrate, Moradabad to furnish a factual report in the matter.

Accordingly, the joint Committee has filed its report to the effect that the unit is compliant.

Even though it is difficult to hold that the report is satisfactory, in absence of any tangible material and appearance of aggrieved party before the Tribunal, the matter is disposed of without prejudice to remedy of the aggrieved party in accordance with law.
