Judgment
Counsel for opposite parties is present.
None for the applicant. We have perused the record. Initially, the O.A. was listed on 16.07.2026 but none was present on behalf of the applicant and the date was adjourned to 21.08.2026.
On 21.08.2026 also, none was present in spite of revised call. Therefore, we gave an opportunity to counsel for applicant and the date for today was fixed but again, none is present on behalf of the applicant. Neither any application for adjournment nor any pass over has been moved.
In view of above, it appears that applicant is not interested in proceeding with the case.
In view of above, considering the previous conduct of counsel for applicant, the O.A. is dismissed for want of prosecution accordingly.
The Tribunal has not considered the application on the point of condonation of delay.
OA along with M.A. No. 349/2026, is dismissed accordingly.
No order as to costs.
