Hon’ble Mr. R.N. Singh, Member (J):
Neither the applicant nor his counsel present today.
The present OA has been filed under Section 19 of the Administrative Tribunals Act, 1985 in March 2021. The same was listed for admission on 16.3.2021. At the outset, learned counsel for the applicant sought an adjournment to enable him to file an application seeking condonation of delay, if so advised, and the matter was ordered to be listed for 26.4.2021. Thereafter, this matter was listed on 26.4.2021 when none was present on behalf of the applicant. Of course, respondents were represented through their counsels in view of advance service.
Today again, there is no appearance on behalf of the applicant. Besides any application seeking condonation of delay, in view of liberty sought and granted vide Order dated 16.3.2021, is also not on record. It appears that applicant has lost interest in pursuing the present OA. Accordingly, the present OA is dismissed in default and for non-prosecution. No costs.
