Sandeep & Ors vs State of Haryana

This OA has been registered on the basis of the letter received from the resident of Village Dokha Dina, District Charkhi Dadri, Haryana with the allegation that a factory has been set up by Kohinoor Black Salt which is involved in the process of changing the colour of salt while putting white salt in earthenpot and heating it. It is alleged that in that process coal and plastic waste is used which produces poisonous smoke and is affecting the health of nearby local residents. It is also alleged that open disposal of residue salt and muck has adverse effect on fertility of agricultural land. Allegation is that the concerned unit has not taken necessary Environmental Clearance (EC) from the competent authority.

Considering the grievance, we are of the opinion that at the first instance the competent authority i.e. the Haryana State Pollution Control Board (HSPCB) can consider the grievance of the applicant and take necessary remedial action, if allegation made in the petition is found to be correct.

Hence, we dispose of the present petition by directing the HSPCB to duly consider the grievance noted above and carryout spot inspection and ascertain the position of necessary EC by the unit concerned and if any violation is noted then the action in accordance with law be taken after giving an opportunity of hearing to Project Proponent without any delay.

Let the above exercise be completed within a period of eight weeks from the date of receipt of a copy of this order and an action taken report be filed before the Registrar General of this Tribunal within 10 weeks by e-mail at [email protected] preferably in the form of searchable PDF/OCR Support PDF and not in the form of Image PDF. If found necessary, the Registrar General may place the matter before the Bench for consideration.

The Registry is directed to send a copy of this order alongwith a copy of complaint letter to the Member Secretary, HSPCB for compliance.

Subject to above, the OA is disposed of.
