Judgment

The petitioner has filed the present petition for grant of following relief:
“Writ of certiorari quashing the public notice issued by respondent No. 2 vide No. NT/P/58 dated 20.09.2021 whereby the notice has been published inviting the applications for the nomination of Village Lambardar without complying the provision of Jammu & Kashmir Lambardari Act and Rules framed thereunder.
With further writ of mandamus commanding the respondents to fill up the post of village Lambardar by complying the provision of J&K Lambardari Rules 1980 by holding the election of the candidates by inviting applications from the eligible candidates of the village Sajwal.
With further writ of prohibition prohibiting the respondents no. 2 & 3 from nominating any candidate as Lambardar of the village without conducting the elections giving equal opportunity of participation in the election of Lambardar. Any other writ or direction as this Hon’ble Court may deem fit and proper in the facts and circumstances of the case”
The official respondents have filed the response stating therein that three applications were received for the appointment of Lambardar, out of which, only candidate namely, Ajay Singh fulfilled the eligibility criteria as per Lambardari Act, 1982, as such, his name was recommended for appointment as Temporary Lambardar subject to the confirmation by the Deputy Commissioner, Jammu.
In view of this, the present petition is disposed of by directing the official respondents to hold elections for the post of Lambardar of Village Sajwal, Tehsil Pargwal, District Jammu within a period of three months from the date a certified copy of this order is made available to the respondents.
