CM is disposed of.

1.

Through the medium of instant petition, petitioner has sought a direction to respondents to issue the nomination/ engagement for the post of

Lambardar in his favour.

2.

I have heard learned counsel for the petitioner and perused the material on record.

3.

It is the case of the petitioner that the post of Lambardar of Village Wussan Bangil fell vacant due to resignation of the Lambardar in the month of

November, 2020, pursuant to which inhabitants of the Village approached the Divisional Commissioner, Kashmir, for seeking nomination/appointment

of Lambardar of the said Village. It is further averred that the Divisional Commissioner, Kashmir, forwarded representation to respondent No.2 with a

direction to look into the matter, who in turn endorsed the same to respondent No.3. The respondent No.3 directed respondent No.4 to go through the

contents of the representation and take appropriate action after visiting the Village in question.

4.

It is further submitted that the respondent No.4 received six applications including one from the petitioner but only petitioner was found eligible to

the post of Lambardar in terms of Rule 3 of the Jammu and Kashmir Lambardari Rules, 1980

5.

According to petitioner, despite petitioner being the only eligible candidate, the respondent No.4 is delaying the matter with regard to issuance of

engagement order in favour of the petitioner.
