Hon’ble Mr. R.N. Singh, Member (A):

In the present OA, the applicant has challenged the termination order dated 21.02.2020 (Annexure A/1) issued by the respondents.

Learned counsel for the respondents who appears on advance service, at the outset, submits that the applicant has approached this Tribunal without availing the statutory remedy inasmuch as impugned order is appealable before the appellate authority, i.e., the Regional Manager (DTC) under the provisions of Rule 15 (3) of Delhi Road Transport Authority (Conditions of Appointment & Services) Regulations, 1952.

In view of the aforesaid, learned counsel for the applicant seeks permission to withdraw the OA with liberty to the applicant to approach the appellate authority by way of statutory appeal. Permission is granted.

The OA stands dismissed as withdrawn with liberty as aforesaid.
