Judgment
Hon’ble Mr. R.N. Singh, Member (J):
Learned counsel for the applicant seeks permission to withdraw the present OA with liberty to the applicant to avail statutory remedy by way of filing an appeal against the order impugned in the present OA. She further submits that the applicant has opposed this Tribunal by way of the present OA as advised by the counsel and has not availed that statutory remedy of an appeal and in the circumstances, the appeal might have being delayed. She prays that if the applicant prefers the statutory appeal within 15 days from today, it may be directed that the respondents shall consider the said appeal on merit and shall not reject the same on the ground of being delayed. To such prayer of the applicant, learned counsel for the respondents has no objections.
In view of prevalent Covid-19 pandemic, permission is granted with liberty and observations as above. Accordingly, the OA stands dismissed as withdrawn with liberty, as aforesaid. No costs.
