Application is registered based on a complaint received by e-mail
This original application has been registered under Sections 14 and 15 of National Green Tribunal Act, 2010 (hereinafter referred to as ‘NGT Act, 2010’) on a letter petition dated 05.06.2022 received from one Raju Chhabra, President, Zone G17, Association, G-13, Friends tower opposite Jwala Heri Market Paschim Vihar, New Delhi – 110063.
The grievance is that there is a commercial complex located in Paschim Vihar opposite commercial complex of the complainant wherein there is a Haldiram’s outlet which has installed chimney outside the premises and causing noise pollution.
It is not the case of applicant that noise emitting from said outlet is beyond permissible limit and therefore it cannot be said that any substantial question relating to environment has arisen out of implementation of the scheduled enactments under NGT Act, 2010. Therefore, we find this complaint not within jurisdiction of this Tribunal under NGT Act, 2010.
The application is accordingly rejected.
