Rajesh Kumar vs State of Haryana

This original application is registered on the basis of the letter petition sent by one Rajesh Kumar, resident of Deshraj Colony, Panipat.

It has been alleged in the said letter petition that for the purpose of collection, transportation, and disposal of the domestic waste within Nagar Municipal Corporations of Sonipat, Panipat, Samalkha and municipality of Ganaur contract has been awarded to one M/s. J B M Environment and the complaint is in respect of irregularities committed by the said company. The letter petition alleges that the company had started the work in the above municipalities in the year 2018 and as per the contract the company was required to dispose of the waste which has been lifted but the company has stored about 8 lakh tones of domestic waste in the dumping site whereas the plant was started almost two years back. On account of storage of waste and its non-disposal, the quality of the soil is affected. It has also been alleged that company is illegally extracting the ground water in waste to energy plant which has been set up in Murthal whereas as per the contract, the company was required to take water from nearby STP.

Having considered  the allegations which are made in  the letter petition, we find that at the first instance the Secretary, Haryana PCB must consider the grievance and take appropriate remedial measures. The Secretary, HSPCB will examine the lapses in the working of the company as alleged in the letter petition and also take appropriate action if the same are found to be correct. Let this exercise be completed by the Secretary, Haryana PCB within a period of three months and an action taken report be submitted before the Registrar General of the Tribunal within four months, if found necessary, the matter may be placed before the Court for consideration.
