Judgment
This original application is registered on the basis of the letter petition received from the resident of Bharathiyar Street, Srinivasapuram, Mayiladuthurai, Thiruvarur District in Tamil Nadu. The complaint made in the letter petition is that Kadvangudi Panchayat Union is dumping solid waste close to the agricultural land near the banks of the Khotankudi Canal in violation of MSW Rules, 2016, which is causing harm to the surrounding farmers and farmlands and also resulting in pollution of waterbody, ground water pollution and unsanitary conditions. It is stated that garbage so dumped is very smelly and is causing health hazards.
As per the letter petition, though the complaint was made to the concerned authorities, but no action has been taken. The plea raised in the letter petition reveals that substantial issue relating to the environment is involved. Hence, at this stage, we implead following authorities as respondents in the matter:-
i. Member Secretary, Tamil Nadu State Pollution Control Board
ii. President, Kaduvangudi Panchayat
Let notice be issued to the said respondents for filing their replies on the next date before the appropriate Bench.
Since the matter relates to Southern Zone Bench, therefore, it is transferred to the said Bench for appropriate further action in the matter.
List this matter on 15.12.2023 before the Southern Zone Bench, Chennai.
