This Original Application is registered on the basis of the letter petition received from one Ram Sujan Yadav and other residents of Village Tikariya, Tehsil – Kundam, Jabalpur, Madhya Pradesh. The grievance raised in the letter petition is in respect of cutting of trees in the reserve forest land of forest village Kundwara forest post Baghraji forest range Kundam in an area of about 20 acres. The allegation is that one Raju Singh Thakur and forest guard Sanjay Haldkar in collusion have taken illegal possession of the forest land and have cut Sagon and Satktha trees and are cultivating the land. It is stated that one of them is a head constable in the Madhya Pradesh Special Armed Force (SFP) and they are also involved in illegal digging by using tractor and dumper and they are cutting the trees of the reserve forest and selling it and are in the process of grabbing 20 acres of reserve forest land.

The letter petition raises substantial issue relating to compliance of environmental norms.

Hence, we implead the following as respondents in the matter:

(i) Madhya Pradesh Pollution Control Board, through its Member Secretary

(ii) Principal Chief Conservator of Forest, State of Madhya Pradesh

(iii) Regional Officer, Ministry of Environment, Forest & Climate Change, Bhopal

(iv) Mr. Raju Singh Thakur

(v) Mr. Sanjay Haldkar, forest guard

(vi) District Magistrate, Jabalpur

The full particular and address of Respondent No. 4 & 5 are not mentioned in the letter petition hence they may be served through the District Magistrate, Jabalpur.

Let  notice  be  issued  to  the  above  Respondents  for  filing  their response atleast one week before the next date of hearing before the appropriate bench of the Tribunal.

Since  the  matter  relates  to  the  Central  Zonal  Bench,  Bhopal, therefore, OA is transferred to the Central Zonal Bench for appropriate further action. Office is directed to transfer the original record of the OA to Central Zonal Bench, Bhopal.
