Judgment
Ld. Interim Resolution Professional with his Counsel appears. Ld. Counsel for the Operational Creditor appears. Ld. Counsel for the Corporate Debtor appears.
It is jointly submitted by the Ld. Counsel for the Operational Creditor as well as the Corporate Debtor that the matter was settled out of the Tribunal and the Ld. Counsel appearing for the Operational Creditor submits that she has filed CA(IB) No. 1197/KB/2019 under Rule 11 of the NCLT Rules, 2016 for withdrawal of the C.P. Being satisfied that the matter was settled before constitution of Committee of Creditors, this application is maintainable under Rule 11 of the NCLT Rules and the permission is granted to withdraw the C.P. in the instant case.
In the meanwhile, Ld. Interim Resolution Professional submits that resolution costs and his fees has been paid. He is hereby discharged from the responsibility of Interim Resolution Professional in the matter.
CP is disposed of as withdrawn. Accordingly, CAs are also disposed of.
