2/05.08.2026 Heard learned counsels for petitioners and for State.

The petitioners are apprehending their arrest in connection with Hussainabad PS Case No.38 of 2026, for offence registered under section 80(2) and 3(5) of BNS, 2023, pending in court of learned SDJM, Palamu.

Learned counsel for petitioners submits that petitioner no.1 is the son of sister-in-law of the deceased. He next submits that he is a student and to buttress his such argument, he refers to Migration Certificate as contained in Annexure-2 issued by the Jharkhand Academic Council, JAC, Ranchi. He next submits that so far as the petitioner no.2 is concerned, she is mother-in-law and is aged about 70 years, and there are general and omnibus allegations against the petitioners and only allegation is made that in one of the Panchayati proceeding, the petitioners were present. He next submits that apart from that there is no allegation against the petitioners and the husband is in jail custody and the cause of death is said to be asphyxia due to hanging.

Learned State counsel opposes prayer and submits that within seven years of marriage, the death of the deceased has occurred.

Considering that the petitioner no.1 is son of the sister-in-law of the deceased and is a student which is fortified in light of Annexure-2 and the petitioner no.2 is said to be mother-in-law and she is aged about 70 years and the death is said to be asphyxia due to hanging, I am inclined to grant anticipatory bail to petitioners.

Accordingly, both the petitioners, above named, are hereby directed to surrender before learned court within three weeks from today, and in event of their surrender/arrest, both the petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each, with two sureties of like amount each, to satisfaction of learned SDJM, Palamu, in connection with Hussainabad PS Case No.38 of 2026, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
