2/13.08.2026 Heard learned counsels for petitioners and for State.

The petitioners are apprehending their arrest in connection with Putki (Munidih O.P.) PS Case No.51 of 2026, for offence registered under section 117(2), 126(2), 109(1), 309(4), 352(3), 3(5) of BNS, 2023, pending in court of learned Civil Judge (Sr.Division) VII-Cum- Judicial Magistrate, Dhanbad.

Learned counsel for petitioners submits that the petitioner no.1 is own brother of the informant and petitioner no.2 is son of the petitioner no.1. He next submits that both the brothers fought among each other and there are case and counter case between them and both have received simple injury and on these grounds, the learned counsel for the petitioners submits that anticipatory bail may kindly be granted.

Learned State counsel opposes prayer and submits that allegations are there of assault and in view of that anticipatory bail may kindly be rejected.

Considering that petitioner no.1 is own brother of the informant and petitioner no.2 is said to be nephew of the informant and free-fight has occurred between both the brothers and the injury is said to be simple, I am inclined to grant anticipatory bail to both the petitioners.

Accordingly, both the petitioners, above named, are hereby directed to surrender before learned court within three weeks from today, and in event of their surrender/arrest, the petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each, with two sureties of like amount each, to satisfaction of learned Civil Judge (Sr.Division) VII-Cum- Judicial Magistrate, Dhanbad, in connection with Putki (Munidih O.P.) PS Case No.51 of 2026, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
