Judgment
Mr. Justice L. Narasimha Reddy, Chairman:-
This contempt case is filed alleging that the respondents did not implement the order dated 16.11.2016 passed in OA No.1698/2019. In the said order, the Tribunal directed the respondents to grant pensionary benefits to the applicant under the Pension Rules.
The respondents filed a detailed reply stating that on 09.11.2020, the pension of the applicant was released.
We heard Shri R.K. Shukla for Ms. Harvinder Oberoi, learned counsel for applicant and Shri V.S.R. Krishna and Shri Subhash Gosain, learned counsel for respondents.
The applicant contends that though the respondents released the pension, they did not pay Gratuity. A perusal of the order in the OA discloses that the direction was only to release the pension under the Pension Rules and there was no mention about the Gratuity. We are of the view that the respondents have implemented the order in the OA. The contempt case is, accordingly, closed.
