Judgment
This Original Application under Section 14 and 15 of National Green Tribunal Act, 2010 (hereinafter referred to as ‘NGT Act, 2010’) has been registered exercising suo-moto jurisdiction on a letter petition dated 10.08.2023 sent by Pankaj Sharma, r/o VPO Mahakal, Tehsil Baijnath, District Kangra, State of Himachal Pradesh complaining that there stood several green trees in Village Mahakal, Tehsil Baijnath, District Kangra and some of the green trees have been cut illegally without taking permission from competent authority and despite complaint, no action has been taken by concerned authorities in the matter.
In our view, compliant made in this original Application, at the first instance, can be looked into by local authorities. Hence, we constitute a joint Committee comprising State PCB, District Magistrate, Kangra and Divisional Forest Officer, Kangra who shall visit the site, collect relevant information and if finds the complaint of felling of green trees illegally true, would take appropriate punitive, remedial and preventive action in accordance with law.
District Magistrate, Kangra shall be the nodal agency for coordination and compliance.
The aforesaid exercise shall be undertaken by said Committee within two months.
A compliance report shall be submitted to Registrar General of this Tribunal by e-mail at [email protected] preferably in the form of searchable PDF/ OCR Support PDF and not in the form of Image PDF, who if find necessary, may place the matter before Tribunal for further orders.
With the above direction, this application is disposed of.
A copy of this order be forwarded to State PCB, District Magistrate, Kangra and Divisional Forest Officer, Kangra by e-mail for compliance.
