Application is registered based on a complaint received by post
This is a letter petition sent by one Pankaj Bhatnagar, resident of House No. 53, Pardabagh, Darya Ganj, New Delhi. The author of the application is also present in person and made his submissions.
The grievance is that there is a lady's park in Pardabagh in which SDMC has made several encroachments, constructions etc. and that is how has damaged the green area and sanctity of park. However, in the entire letter, we do not find as to when this encroachment activities were carried out by SDMC. When questioned, Shri Bhatnagar admitted that these activities were carried out more than five years ago. That be so, under Section 14 of National Green Tribunal Act, 2010, Tribunal has a period of limitation of five years and apparently grievance raised by means of the letter in question, is barred by limitation.
We therefore, reject this application but make it clear that if the applicant has remedy elsewhere, he may avail the same.
The application is accordingly rejected.
