This Criminal Petition has been filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short, 'BNSS') by the petitioner/respondent No.1 seeking direction for expeditious disposal of DVC No.3 of 2024, on the file of the Junior Civil Judge-cum-Judicial Magistrate of First Class, Rangareddy District at Chevella.

Learned counsel for the petitioner submitted that pursuant to the order dated 11.06.2026, they sent personal notice to respondent No.2 and filed proof of service vide USR No.79762 of 2026 on 13.07.2026. According to the learned counsel, notice sent by them was delivered to respondent No.2 on 16.06.2026. In spite of the same, respondent No.2 has not chosen to enter appearance. Hence, this Court is not having any option except to proceed with the matter in accordance with law.

Heard Mr. N.Krishna Sumanth, learned counsel, representing Mr. S.Ram Reddy, learned counsel for the petitioner, and Mr. V.Jithender Rao, Additional Public Prosecutor, appearing on behalf of respondent No.1-State.

Learned counsel for the petitioner submitted that respondent No.2 filed DVC No.3 of 2024 before the Junior Civil Judge-cum-Judicial Magistrate of First Class, Rangareddy District at Chevella, invoking the provisions of Section 12 of the Protection of Women from Domestic Violence Act, 2005 (hereinafter referred to as 'the Act') against the petitioner and others claiming various reliefs. The matter before the trial Court is coming up for the evidence of respondent No.2. Due to non-cooperation of respondent No.2, the trial Court is adjourning the matter from time to time. Unless this Court issues necessary direction to conclude the trial and dispose of the matter by fixing time limit, the petitioner will be put to great hardship.

Taking into consideration the submissions made by the learned counsel for the petitioner and the grounds raised in the present Criminal Petition, this Court, without expressing any view on the merits of the case, directs the learned Junior Civil Judge-cum-Judicial Magistrate of First Class, Rangareddy District at Chevella, to conclude the trial and dispose of DVC No.3 of 2024 as expeditiously as possible. The parties in the lis shall cooperate with the trial Court for disposal of the matter without seeking any undue adjournment. The petitioner is granted liberty to renew his request for fixation of the time limit whenever the cause arises.

With the above said direction, the Criminal Petition is disposed of. Miscellaneous applications, pending if any, shall stand closed.
