Judgment
This Criminal Petition has been filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short, 'BNSS') by the petitioners seeking a direction for expeditious disposal of DVC No.2 of 2025, on the file of the learned Judicial Magistrate of First Class, Peddapalli, by fixing time limit.
Heard Mrs.Vladimer Khatoon, learned counsel for the petitioners, and Mr.Jithendar Rao Veeramalla, learned Additional Public Prosecutor appearing on behalf of respondent No.1-State.
Learned counsel for the petitioners submitted that the petitioners are not seeking any relief against respondent Nos.2 to 6 and they were made as proforma parties. The petitioners are seeking a direction to the trial Court for early disposal of DVC No.2 of 2025. Hence, notice in respect of respondent Nos.2 to 6 is not required.
The said submission has not been disputed by the learned Additional Public Prosecutor.
Learned counsel for the petitioners submitted that petitioner No.1 filed DVC No.2 of 2025, on her behalf and also on behalf of her minor children, who are petitioner Nos.2 and 3, claiming various reliefs under the provisions of the Domestic Violence Act, 2005 against respondent Nos.2 to 6. The learned trial Court neither disposing the interlocutory applications filed by the petitioners for grant of interim maintenance nor main DVC. Due to the same, the petitioners will be put to great hardship. Unless this Court issues necessary direction to the trial Court to conclude the trial and dispose of DVC No.2 of 2025 by fixing time limit, the petitioners will be put to great hardship.
Taking into consideration the submissions made by the learned counsel for the petitioners, this Court, without expressing any view on the merits of the case, directs the learned Junior Civil Judge-cum-Judicial Magistrate of First Class, Peddapalli, to dispose the interim application, pending if any, or DVC No.2 of 2025 filed by the petitioners as expeditiously as possible preferably within a period of six (6) months from the date of receipt of a copy of this order. The parties in the lis shall cooperate with the trial Court for disposal of the matter without seeking any undue adjournment.
With the above said direction, the Criminal Petition is disposed of.
Miscellaneous applications, pending if any, shall stand closed.
