Judgment
This Criminal Petition has been filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short, 'BNSS') by the petitioner seeking a direction for expeditious disposal of S.T.C. NI.No.182 of 2024, on the file of the learned III Additional Junior Civil Judge-cum-X Additional Judicial Magistrate of First Class, Medchal.
Heard Mr.B.Narsimhulu, learned counsel for the petitioner, and Mr.Jithendar Rao Veeramalla, learned Additional Public Prosecutor appearing on behalf of respondent No.4-State.
Notice in respect of respondent Nos.1 to 3 is dispensed with on the ground that the petitioner is not seeking any relief against them and he is only seeking a direction to the trial Court for expeditious disposal of S.T.C. NI.No.182 of 2024.
Learned counsel for the petitioner submitted that the petitioner has filed STC.NI.No.182 of 2024 against respondent Nos.1 to 3 before the trial Court and the same is pending since 2024. Unless this Court issues necessary direction to the trial Court to conclude the trial and dispose of STC.NI.No.182 of 2024, the petitioner will be put to great hardship.
Learned Additional Public Prosecutor submitted that there are several old cases are pending before the trial Court and therefore, the petitioner is not entitled to seek for expeditious disposal of STC.NI.No.182 of 2024.
Taking into consideration the submissions made by the respective parties, this Court, without expressing any view on the submissions made by either of the parties, directed the learned III Additional Junior Civil Judge-cum-X Additional Judicial Magistrate of First Class, Medchal, to conclude the trial and dispose of STC.NI.No.182 of 2024 as expeditiously as possible. The parties in the lis shall cooperate with the trial Court for disposal of the matter without seeking any undue adjournment. However, the petitioner is granted liberty to approach this Court for fixing time limit whenever the cause arises.
With the above said direction, the Criminal Petition is disposed of.
Miscellaneous applications, pending if any, shall stand closed.
