Judgment
This is an application to extend the time granted for curing the defects.
The facts of the case are that the Applicant filed the Restoration Application (RA) on 08.12.2022 and the Office after scrutiny of the RA, intimated the defects to the Applicant on the same day and returned the RA to the Applicant on 09.12.2022. The Applicant re-filed the RA on 16.12.2022. It is stated in the Interlocutory Application (IA) that due to some technical error on the NCLAT e-filing portal the application could not be re-filed on 14.12.2022 and the same was filed on 15.12.2022 after multiple attempts made throughout the day. Hence, there is delay of one day in re-filing the RA, so the same may be condoned.
Heard learned Counsel appearing for the Applicant and perused the averments made in the IA as well as Office report.
Considering the submissions made on behalf of the Applicant and for the reasons mentioned in the IA, which are sufficient, the delay in refiling the RA is hereby condoned.
With the aforesaid order, this IA stands disposed of.
