Judgment
This is an application to extend the time granted for curing the defects.
The facts of the case are that the Applicant filed the Interlocutory Application (IA) on 21.10.2022 and the Office after scrutiny of the IA on 28.10.2022, intimated the defects to the Applicant on the same day and returned the IA to the Applicant on 02.11.2022. The Applicant re-filed the IA on 09.11.2022. It is stated in the Interlocutory Application (IA) that after filing of the Application defects were raised, which were resolved but some new defects were raised and while curing the defects, it was informed that an Application for condonation of delay was also required. Hence, there is delay of 05 days in re-filing the IA, so the same may be condoned.
Heard learned Counsel appearing for the Applicant and perused the averments made in the IA as well as Office report.
Considering the submissions made on behalf of the Applicant and for the reasons mentioned in the IA, which are sufficient, the delay in refiling the IA is hereby condoned.
With the aforesaid order, this IA stands disposed of.
