Judgment
This is an application to extend the time granted for curing the defects.
The facts of the case are that the Applicant filed the Interlocutory Application (IA) on 01.11.2022 and the Office after scrutiny of the IA, intimated the defects to the Applicant on the same day and returned the IA to the Applicant on 07.11.2022. The Applicant re-filed the IA on 17.11.2022. It is stated in the Interlocutory Application (IA) that as the present Applicant is in Judicial Custody in Mandoli Jail, Delhi it was very difficult to get the documents and signatures for the purposes of the removal of objections in the Application. Hence, there is delay of 09 days in re-filing the IA, so the same may be condoned.
Heard learned Counsel appearing for the Applicant and perused the averments made in the IA as well as Office report.
Considering the submissions made on behalf of the Applicant and for the reasons mentioned in the IA, which are sufficient, the delay in refiling the IA is hereby condoned.
With the aforesaid order, this IA stands disposed of.
