Judgment
This is an application to extend the time granted for curing the defects.
The facts of the case are that the Applicant filed the Interlocutory Application (IA) on 01.12.2022 and the Office after scrutiny of the IA on 02.12.2022, intimated the defects and returned the IA to the Applicant on the same day. The Applicant re-filed the IA on 15.12.2022. It is stated in the Interlocutory Application (IA) that procuring the original Board Resolution in favour of the Authorized Signatory from the office of the Applicant Bank, located in Mumbai, took significant time. Further, curing the rest of the notified defects also took some time. Hence, there is delay of 06 days, in re-filing the IA, so the same may be condoned.
Heard learned Counsel appearing for the Applicant and perused the averments made in the IA as well as Office report.
Considering the submissions made on behalf of the Applicant and for the reasons mentioned in the IA, which are sufficient, the delay in refiling the IA is hereby condoned.
With the aforesaid order, this IA stands disposed of.
