Judgment
This is an application to extend the time granted for curing the defects.
The facts of the case are that the Applicant filed the Interlocutory Application (IA) on 01.12.2022 and the Office after scrutiny of the IA on 02.12.2022, intimated the defects to the Applicant on the same day and returned the IA to the Applicant on 07.12.2022. The Applicant re-filed the IA on 14.12.2022. It is stated in the Interlocutory Application (IA) that Applicant removed the suggested defects and uploaded the rectified copy of the Application on the official portal on 05.12.2022, however, the Applicant was not aware that the hard copy of the re-filed Application is also required to be submitted to the Registry. Hence, there is delay of four days’ in re-filing the IA, so the same may be condoned.
Heard learned Counsel appearing for the Applicant and perused the averments made in the IA as well as Office report.
Considering the submissions made on behalf of the Applicant and for the reasons mentioned in the IA, which are sufficient, the delay in refiling the IA is hereby condoned.
With the aforesaid order, this IA stands disposed of.
