Judgment
This is an application to extend the time granted for curing the defects.
The facts of the case are that the Applicant filed the Restoration Application (RA) on 17.10.2022 and the Office after scrutiny of the RA, intimated the defects and returned the RA to the Applicant on the same day. The Applicant re-filed the RA on 05.11.2022. It is stated in the Interlocutory Application (IA) that though the e-filing/ soft copy was filed, but the hard copy was not filed as the Junior colleague was under impression that soft copy of refiling through e-filing was sufficient alone. Hence, there is delay of 12 days in re-filing the RA, so the same may be condoned.
Heard learned Counsel appearing for the Applicant and perused the averments made in the IA as well as Office report.
Considering the submissions made on behalf of the Applicant and for the reasons mentioned in the IA, which are sufficient, the delay in refiling the RA is hereby condoned.
With the aforesaid order, this IA stands disposed of
