Heard learned counsels for petitioners and for State.

The petitioners are apprehending their arrest in connection with Petarwar P.S Case No.73 of 2026, for offence registered under section 132, 324(4) and 3(5) of BNS, 2023, pending in court of learned S.D.J.M., Bermo at Tenughat.

Learned counsel for petitioners submits that the allegations are made that nine named persons and about 100 unknown persons have gone to the spot and interrupted in Bhumi Pujan programme in connection with the proposed Solar Power Plant. He next submits that there are general and omnibus allegations against all the accused persons and the agitation was going on as the Solar Power Plant was being constructed without following the land acquisition procedure. He next submits that the alleged occurrence is said to be of 28.04.2026 and the FIR was lodged on 07.05.2026.

Learned State counsel opposes prayer and submits that the petitioners are the members of unlawful assembly and in view of that the anticipatory bail may kindly be rejected.

Looking to the FIR, it transpires that there are general and omnibus allegations against the petitioners and it has been pointed out that the agitation was going on as the Solar Power Plant was being constructed without following the land acquisition procedure and the said occurrence is of 28.04.2026 and the FIR is of dated 07.05.2026 and the petitioners have got no criminal antecedent as aforesaid, I am inclined to grant anticipatory bail to petitioners.

Accordingly, petitioners, above named, are hereby directed to surrender before learned court within three weeks from today, and in event of their surrender/arrest, petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/-(Rupees Twenty Five Thousand), with two sureties of like amount each, to satisfaction of learned S.D.J.M., Bermo at Tenughat, in connection with Petarwar P.S Case No.73 of 2026, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
