Judgment
Challenging the action of respondent Nos. 3 and 4 in interfering with the civil disputes between the petitioners and respondent Nos.5 to 8 and in not taking action on the complaint of the petitioners dated 23.07.2026, as illegal and arbitrary, this writ petition has been filed.
Heard the learned counsel for the petitioners and the learned Assistant Government Pleader for Home, appearing for respondent Nos.1 to 4.
Learned counsel for the petitioners submitted that the petitioners have been called to the police station and the Circle of Inspector of Police i.e., respondent No.3 has forced petitioner No.2 to give an undertaking that he shall not enter into the subject land and the same is, therefore, illegal. A copy of the undertaking has also been filed at page 23 of the writ petition. This Court had, therefore, directed respondent No.3 to appear before this Court and explain the situation. Respondent No.3 has appeared and it is submitted that the said undertaking has not been given to the police and it is signed by petitioner No.2 and the witness is the petitioner's son and the same is created for the purpose of filing the writ petition.
Learned counsel for the petitioners, however, submitted that the petitioners have made a complaint to the Superintendent of Police and have also submitted the video recording of the Constable coming to the site.
However, on going through the written instructions, it shows that there was a complaint from Thalla family on 07.07.2026 and, therefore, the petitioners were called to the police station for inquiry and after inquiry, it was found to be a civil dispute and, therefore, the said complaint has been closed.
In view of these submissions and also the averments in the written instructions that there is no interference by the respondent police into the civil dispute and that they have not taken any coercive action against the petitioners herein, the writ petition is disposed of directing the respondent police not to interfere in the civil disputes between the petitioners and respondent Nos.5 to 8 and not to call the petitioners to the police station without any justifiable cause. The petitioners are at liberty to pursue the complaint before the Superintendent of Police, if they are so advised. There shall be no order as to costs.
Miscellaneous applications, if any, pending shall stand closed.
