Judgment
The grievances in the present letter petition sent by Mr. Nagendra Tripathi and Anupam Jaiswal residents of Prayagraj, Uttar Pradesh are regarding illegal construction and unauthorized storage of minerals in Anand Bhawan in Heritage Zone of Prayagraj.
As provided in Section 14 of the National Green Tribunal Act, this Tribunal has jurisdiction over all civil cases where a substantial question relating to environment (including enforcement of any legal right relating to environment), is involved and such question arises out of the implementation of the enactments specified in Schedule I. The complaint made by the applicants is general and vague and lacks requisite particulars. The grievances of the applicants regarding illegal construction and unauthorized storage of minerals also do not involve any substantial question relating to environment arising out of the implementation of the enactments specified in schedule I to the National Green Tribunal Act, 2010.
In view of the above, this application is dismissed without prejudice to availing of appropriate remedies by the applicants.
