Judgment
Grievance of the applicant is that car parking area in F-Block market situated in BRS Nagar, Ludhiana has been substantially converted into commercial and thereby parking area has been reduced in violation of Punjab Building Bylaws, 2018 and Punjab Regional Town and Planning and Development Act, 1995. It is said that this has resulted in violation of environmental laws and Environment Protection Act, 1986.
We find that conversion of some parking area in another category and violation of local laws by itself is not within our jurisdiction. Section 14 says that a substantial question relating to environment if has arisen due to implementation of enactments mentioned in schedule of NGT Act, 2010 only then the Tribunal can adjudicate upon the same.
Mere violation of local laws does not result in violation of environmental laws and there is nothing in the original application which may demonstrate that there is any violation of environmental laws.
The application therefore is not maintainable and accordingly, dismissed.
