Judgment
Delivered by Hon’ble Mr. Justice Rajiv Joshi, Member (Judicial)
Heard Shri Dharmendra Tiwari, learned counsel for the applicant and Shri Devendra Narayan Pandey, learned counsel for the respondents.
Learned counsel for the respondents submits that against the order dated 27.08.2025 passed in OA No.372/2011, the Union of India has preferred Writ (A) No.13445 of 2026 before the Hon’ble High Court of Judicature at Allahabad in which the Hon’ble High Court while staying the effect and operation of the aforesaid order passed the order on 31.08.2026, which is reproduced as under :-
“1.It is submitted by counsel for the petitioners that the Tribunal in para-11 has proceeded on the alleged admitted position that no show cause notice was issued to the applicant before imposing higher penalty by the appellate/revisional authority, which is factually incorrect, inasmuch as the applicant himself had annexed Annexure-15 with the Original Application, which was the show cause notice dated 15.04.2008 issued to him and his response dated 29.04.2008 as Annexure-16 to the O.A. and as such the entire basis of the order being non-existent, the same cannot be sustained.
2.In view of the submissions made, issue notice. Issue notice of the stay application also.
3.Steps be taken within a period of one week.
4.List the petition on 02.11.2026.
5.In the meanwhile and till further orders, effect and operation of the order dated 27.08.2025 passed by the Central Administrative Tribunal, Allahabad Bench, Allahabad in Original Application No. 372 of 2011, shall remain stayed.”
Learned counsel for the applicant also confirms the aforesaid order passed by Hon’ble High Court.
In view of the aforesaid circumstances, the proceeding of the contempt petition is closed. The applicant shall be at liberty to seek revival of the petition after appropriate orders are passed by the Allahabad High Court in the pending writ petition, if any.
All pending M.As., if any, shall stand disposed of accordingly.
