Judgment
This Writ Petition is filed challenging the inaction on the part of respondents No.3 and 4 in submitting the police verification report in respect of the petitioner's pending passport renewal application bearing File No.0M0076057674626, dated 14.05.2026, at Indian Consular Application Centre, Muscat, as illegal and arbitrary.
Heard learned counsel for the petitioner, learned counsel representing learned Deputy Solicitor General of India appearing for respondents No.1 and 2 and learned Assistant Government Pleader for Home, appearing for respondents No.3 and 4.
The petitioner is seeking a direction to the respondents to issue the requisite police clearance, without reference to Crime No.82 of 2023, dated 24.04.2023, registered at Konaraopet Police Station, Rajanna Sircilla District, for renewal of the petitioner's passport.
Learned Assistant Government Pleader for Home, has furnished a copy of the written instructions received by him and submitted that the petitioner is an accused in Crime No. 82 of 2023, dated 24.04.2023, on the file of Konaraopet Police Station, Rajanna Sircilla District, registered for the offence punishable under Section 307 of the Indian Penal Code. It is further submitted that a charge sheet has already been filed before the competent Court with a prayer to issue a Non-Bailable Warrant (NBW) against the petitioner. It is further submitted that the case has been taken on file as P.R.C.No.32 of 2023 and the next date of hearing is 28.08.2026, and the present stage of the case is for execution of the Non-Bailable Warrant, which is pending.
Learned counsel for the petitioner submitted that, if the police verification report reflecting the factual position is submitted, the petitioner would take appropriate steps to travel to India and seek issuance of a temporary passport in accordance with law.
In view of the above, the respondents are directed to submit the police verification report, setting out the factual position, before the Indian Consular Application Centre, Muscat, expeditiously and upon submission of such report, the petitioner is permitted to take all necessary and appropriate steps for renewal of the passport, in accordance with law.
With the above directions, this Writ Petition is disposed of. There shall be no order as to costs.
Miscellaneous applications, if any, pending shall stand closed.
