Judgment
Mr. Arvind Kumar Kala, learned Senior Central Government Standing Counsel, appearing for respondent Nos.1 and 2, submitted that in view of the judgment of the Division Bench of this Court in W.A. No.128 of 2026 dated 05.02.2026, the husband of the petitioner is required to approach the concerned Criminal Court and seek No Objection Certificate for renewal of passport.
Mr. M. Mukarram Ali, learned counsel for the petitioner, submitted that the husband of the petitioner would approach the concerned Court of Criminal Jurisdiction.
In view of the aforesaid submissions of the learned counsel, this Court is of the considered view that the husband of the petitioner is required to approach the concerned Court of criminal jurisdiction viz., learned II Additional Judicial Magistrate of First Class, Rajanna Sircilla, where P.R.C. No.32 of 2023 and seek No Objection Certificate for renewal of passport by filing an application; on such application being filed by the husband of the petitioner, the learned II Additional Judicial Magistrate of First Class, Rajanna Sircilla shall dispose of the same as early as possible, preferably, within a period of one (1) week therefrom. Accordingly, the writ petition is disposed of at the admission stage itself. There shall be no order as to costs.
As a sequel thereto, miscellaneous applications, if any, pending in the writ petition stand closed.
