Judgment
Heard Mr. M.A.K. Mukheed, learned counsel for the petitioner and Mrs. N.V.R. Rajyalaxmi, learned standing counsel for Central Government, representing Mr. N. Bhujanga Rao, learned Deputy Solicitor General of India, appearing for respondents.
Grievance of the petitioner is that his application bearing No.HY7076391480326 dated 25.03.2026 for renewal of passport is not being considered on the ground of pendency of criminal case in C.C. No.2907 of 2025 (Old C.C. No.967 of 2018) on the file of the learned Principal Junior Civil Judge-cum-Judicial Magistrate of First Class, Hanamkonda arising out of Crime No.6 of 2016 registered with Warangal-R (Subedari) Police Station for the offences punishable under Sections 498-A and 506 of the Indian Penal Code 1860 (IPC) wherein the petitioner is arraigned as accused No.3. Crl.P. No.6268 of 2021 was filed by the petitioner and other accused persons (in C.C. No.967 of 2018) and interim order dated 11.06.2025 was passed by this Court in I.A. No.2 of 2021 in Crl.P. No.6268 of 2021 staying all further proceedings in C.C. No.2907 of 2025 and the same was extended from time to time.
In view of the stay of criminal proceedings in C.C. No.2907 of 2025, the petitioner is entitled for the relief sought in this writ petition.
Accordingly, this writ petition is disposed of directing respondent No.2 to consider the petitioner's application bearing No.HY7076391480326 dated 25.03.2026 for renewal of passport by taking note of the stay order dated 11.06.2025 passed by this Court in I.A. No.2 of 2021 in Crl.P.No.6268 of 2021 and extended from time to time, and pass appropriate orders in accordance with law, within a period of one (2) weeks from the date of receipt of a copy of this order. There shall be no order as to costs.
As a sequel thereto, miscellaneous applications, if any, pending in the writ petition stand closed.
